No, so long as everyone else is OK with it. You can't edit the collision files or the handling files though.

There are some mods that you can use, as MTA doesn't check all of the files.

Currently the problem is that they don't know how to get guns that fire from first person to work... So no r-launcher, no sniper yet.

They have a post in the general MTA forum, regarding the legality of MTA. They have been given permission by R* to do this.

I've seen him several times on the official servers... He gets kicked pretty fast, and I think there's a ban on one of them.

Yup. Somone basically made an enormous ramp leading up to the top of the building. That's also why you sometimes see people driving around in mid-air.
