Something like this? 

function isPedFighting( ped ) 
	if ( getPedWeapon( ped ) == 0 ) then 
    	local pControl = getControlState( ped, "fire" )
    	local peControl = getPedControlState( ped, "fire" )
    	if ( getElementType( ped ) == "player" and pControl == true ) or ( getElementType( ped ) == "ped" and peControl == true ) then 
      		return true 
     	else 
      		return false
      	end
    end
end
