Using dead server name

Well I dont know if this is the right position to post this but i need to ask something ?

is it legal to use a dead (closed) server name ?

because if its illegal then it will be rly diffcult to get a name since all names are alrdy taken by closed servers ?

It isn't illegal if the name isn't a registered trademark (which is true for almost all servers).

The moral requires that you ask the previous namebearer though (if possible) - at least if we're talking about a "non-standard" name.
